Acceptable Use Policy

1. Purpose
This Acceptable Use Policy ("AUP") governs the use of all services, platforms, software, and digital infrastructure provided by HyperMartX PTY (LTD), trading as ASI Technologies. By using our services, you agree to comply with this policy. Violation of this policy may result in suspension or termination of your access.
2. Scope
This policy applies to all users of ASI Technologies services, including but not limited to:
- Clients using managed IT services, hosted applications, or SaaS platforms.
- Users of websites, web applications, and APIs built or hosted by ASI Technologies.
- Participants in consultations, training sessions, and academy programmes.
- Any individual or entity accessing ASI Technologies infrastructure.
3. Permitted Use
Our services are provided for lawful business and personal purposes. You may use our services to:
- Operate your business applications and digital infrastructure.
- Store, process, and transmit data in accordance with applicable law.
- Communicate with clients, patients, customers, and stakeholders.
- Conduct legitimate business activities as agreed in your service engagement.
4. Prohibited Activities
You may not use ASI Technologies services to:
4.1 Illegal Activities
- Engage in any activity that violates South African law, including the Cybercrimes Act (No. 19 of 2020), POPIA, or the Electronic Communications and Transactions Act.
- Store, distribute, or transmit content that is illegal, including child sexual abuse material, content promoting terrorism, or content inciting violence.
- Facilitate fraud, money laundering, or any form of financial crime.
4.2 Security Violations
- Attempt to gain unauthorised access to any system, network, or data.
- Deploy malware, ransomware, spyware, or any malicious software.
- Conduct port scanning, vulnerability scanning, or penetration testing against ASI Technologies infrastructure without prior written authorisation.
- Intercept, monitor, or tamper with communications not intended for you.
4.3 Abuse & Harassment
- Send unsolicited bulk email (spam), phishing messages, or scam communications.
- Harass, threaten, defame, or intimidate any individual.
- Impersonate any person or entity.
4.4 Resource Abuse
- Use services in a way that degrades performance for other users.
- Deploy cryptocurrency mining software on shared infrastructure.
- Consume excessive bandwidth, storage, or compute resources beyond your service tier without prior agreement.
4.5 Intellectual Property Violations
- Use our services to infringe upon the intellectual property rights of any third party.
- Host, distribute, or link to pirated software, media, or copyrighted material without authorisation.
5. Content Responsibility
You are solely responsible for all data, content, and materials you store, process, or transmit using ASI Technologies services. We do not monitor your content proactively, but we reserve the right to review and remove content that violates this policy upon becoming aware of a violation.
6. Enforcement
ASI Technologies reserves the right to:
- Warn you of a policy violation and request corrective action.
- Suspend your access to services immediately if a violation poses an imminent risk to security, legal compliance, or other users.
- Terminate your service agreement if violations are repeated or severe.
- Report illegal activity to the relevant South African authorities, including the South African Police Service (SAPS) and the Information Regulator.
Where possible, we will provide notice before taking enforcement action. However, we reserve the right to act immediately in cases involving security threats, legal obligations, or imminent harm.

ASI Technologies may update this Acceptable Use Policy at any time. Material changes will be communicated to active clients via email. Continued use of our services after notification constitutes acceptance of the updated policy.
9. Governing Law
This policy is governed by the laws of the Republic of South Africa. Disputes shall be resolved under the jurisdiction of the courts of Pretoria, Gauteng.
